1. General Provisions
1.1 Big Buzz Company Limited (“The Company”,
“we” and “us”, as the case may be), its officers, management, and members of
staff shall, at all times, respect the confidentiality of and use our best endeavors to keep safe any and all personal data (“Personal Data”, as defined in the
Personal Data (Privacy) Ordinance (Cap.486) of China-Hong Kong) (“Ordinance”))
collected from you and/or stored and/or transmitted by you to us.
1.2 This Private Policy (“Policy”) covers our
treatment of Personal Data that we collect when you access to and use the service
at our eShop (“eShop”) with a domain name of www.bigbuzzshop.com. This Policy sets out
purposes of collection of Personal Data, how we use your Personal Data; what
Personal Data we collect; how we protect your privacy; and your legal rights on
your Personal Data.
1.3 You shall read carefully
throughout the Policy to ensure you have a thorough understanding of our practice
in respective of your Personal Data before you decide to provide with us your
Personal Data. In the course of using the eShop, you may be requested to
provide Personal Data for you to use some services of the eShop, including but
not limited to making payment, arranging shipment and subscribing our newsletter.
You are not obliged to provide us your Personal Data as requested. However, we
are not able to render those services to you without your Personal Data and we
shall not assume liability in the occurrence.
1.4 Your continued use
of the eShop and its services shall signify your consent to the collection, use
and disclosure of your personal data by us in accordance with the Policy.
1.5 We reserve the right to amend this Policy from
time to time without notice. The provisions
herein may be updated, revised, varied and amended from time to time as we deem
necessary. Your continued use of the eShop following such revision shall be

1.6 The Policy is written in both English and
Chinese. If there is any discrepancy or inconsistency between the English and
Chinese version, the English version shall take precedent.
2. Purposes of Collection
of Personal Data
We collect your Personal Data
for the following purposes:
2.1 Validate your identity and eligibility of
using our services.
2.2 Execute
payment and refund instructions and verify your identity with the payment
gateways, financial institutions and banks involved in processing the respective
instructions.
2.3 Communicate with
you with regards to your enquires, complaints and orders.
2.4 Process goods delivery
and returns instructions.
2.5 Validate the authenticity of coupons,
promotional codes and membership data.
2.6 Implement direct marketing, omnichannel marketing
and joint promotion with third parties.
2.7 Follow up on your pre-ordered
products and customization services.
2.8 Notify you in respective
of any update and revision of our policies, terms and conditions, logistic arrangement,
product pricing, fees, maintenance schedule and relevant housekeeping matters of
the eShop.
2.9 Enrol you on the mailing list for the
newsletter you subscribed from us.
2.10 Collect usage data for eShop upgrade, customer
journey design and user experience enhancement.
2.11 Evaluate the effectiveness
of marketing and promotional campaigns.
2.12 Use the data for understanding
customer preferences to assist product design.
2.13 Construct a
customer database for customer relationship management.
2.14 Investigate, block
and suspend any suspicious transactions.
2.15 Use the data to
develop and administer customer loyalty programs, compute corresponding bonus
points and discounts.
2.16 Use data as
statistical analysis to understand customer behaviours, purchase history and shopping
patterns.
2.17 Manage the information,
comments and reviews you post on the eShop and our social media or send to us.
2.18 Keep order and
payment history for claims and dispute resolution purposes.
2.18 Comply with regulatory
requirements of the China-Hong Kong Special Administrative Region (“HKSAR”).
3. Collection of Personal Data
2.1. All Personal Data will be collected on a voluntary, open
and fair basis. Certain Personal Data are required for specific services and if
you fail to supply your Personal Data as requested from each specific service,
we may not be able to provide you with our products or services and do not assume
any liability in such occurrence. By providing your Personal Data to us, you
acknowledge that such provision is fair and reasonable in the circumstances.
2.2 When you access the eShop, we may ask you to provide
Personal Data, including but not limited to when you voluntarily register or
update your personal profile, subscribe catalogues or newsletters, send messages
to us, use our customer services, purchase goods, check out, arrange shipment, answer
surveys, enter promotional codes, spend with coupons, register for customer
loyalty program and use its relevant services, write product review, file complaints
and post on our social media.
2.3 We may use cookies or similar technologies on the eShop to
help us manage your user experience and customize contents and presentation
formats for your returned visits. We do not collect or store Personal Data from
you under this circumstance but your domain name server address, email address and
browsing history may be recorded. You can opt to disable cookies or similar
technologies at any time by simply modifying configuration of your browser. As
a result, certain functions and features of the eShop may be unavailable to
you.
4. Disclosure & Transfer
of Personal Data
4.1 We respect the confidentiality of your Personal Data and will
not sell, lease or trade any of your Personal Data for any purpose without your
consent.
4.2 Unless we receive your explicit decline in writing, we may
transfer, disclose, grant access to or share your personal data with the
following parties:
(1) Employees, officers and contract staff of the
Company.
(2) Contractors,
suppliers and service providers of the Company in relation to providing any
relevant services being requested.
(3) Any financial institutions, banks, charge or
credit card issuing companies, credit providers, credit information or
reference bureaux, or collection agencies, security agencies, necessary to
establish and support the payment of any services being requested.
(4) Third Party reward and loyalty programs
providers and customer service operators.
(5) Court
of law, auditors, brokers, insurers, adjusters and/or consultants on a need-to-know
basis.
(6) Government and regulatory authorities and
law enforcement agencies and other organizations, as required or authorized by
law.
(7) Your authorized representatives or your
legal advisers upon your request and with your consent.
(8) Any actual or proposed assigned of all or
any part of the Business and/or asset of the Company.
5. Security and Retention
of Personal Data
5.1 We are committed to
protecting your Personal Data and take reasonably practicable physical,
electronic and administrative measures to ensure that the Personal Data we
collect is protected from unauthorized or accidental access, processing, disposal,
disclosure, misuse or loss.
5.2 We implement physical
securities, including key locked storage and restricted access as protection measures
to your Personal Data.
5.3 We will maintain an
appropriate internal administrative measures to safeguard your Personal Data from
any unauthorized access. Access to your Personal Data by our employees will be on
a restricted and need-to-know basis.

firewalls and Secure Sockets Layer (SSL) encryption technologies and./ or
password protected device to store and transmit your Personal Data.
5.5 You shall not post
your Personal Data in to any public areas at the eShop where anyone can freely
view them in unrestricted manner. We are
not liable for any claims, damages and losses arising out of such occurrence.
5.6 Personal data will
only be retained for as long as is necessary to fulfil the original or directly
related purposes for which it was collected, unless the personal data is also
retained to satisfy any applicable statutory or contractual obligations.
6. Links to External Websites
6.1 The eShop may contain
hyperlinks to external websites that are operated by third parties and under
different privacy policies, which are independent from us and uncontrollable by
us. We are not responsible for the Personal Data such websites collect from you.
You are advised to read and understand their privacy policies before providing
any Personal Data to them.
7. Use of Your Personal Data in Direct Marketing
We may from time to time send to you marketing and promotional
materials and information regarding our products, services and the like based
on the Personal Data that you have provided to us. If you do not wish to
receive further information or materials related to direct marketing,
promotional offers, new products and services from us, please indicate expressly
your intention of opting out from the communication list in writing and send to

8. Data Access and Correction
8.1 You are fully entitled
at any time to making request for access to, make amendments to and/or obtain a
copy of your Personal Data which are retained by us. If you wish to obtain a
copy of any of your Personal Data or if you believe that any of your Personal
Data which we collect and maintain is inaccurate, please inform our Customer
Service Representatives of your request in writing at cs@bigbuzzshop.com or Unit 8A, 22/F, Gold
King Industrial Building, 35 Tai Lin Pai Road, Kwai Chung, N.T., Hong Kong. We
will endeavor to respond to your request(s) within 15 working days upon receipt
of request. In accordance with the Ordinance,
we have the right to charge a reasonable fee for the processing of any data
access request.
